LEXINGTON, Ky.–The U.S. District Court for the Eastern District of Kentucky has dismissed a class-action lawsuit filed against Tempur-Pedic on behalf of shareholders.
According to the mattress manufacturer’s 2007 10-K filing with the U.S. Securities and Exchange Commission, the suit was a “consolidated complaint” of five actions filed against the company between Oct. 7 and Nov. 21, 2005. All of the complaints, filed by shareholders who bought Tempur-Pedic’s stock between April 22 and Sept. 19, 2005, alleged that Tempur-Pedic had made misleading statements concerning the company’s financial condition in that year.
The court issued its ruling to dismiss the complaint “with prejudice and without leave to re-plead” on March 28.
