Bed Bath Settlement Calls for Refund on Synergy Bedding

UNION, N.J.–A pending lawsuit in the Federal District Court for the District of New Jersey alleges that Bed Bath & Beyond and Synergy Inc. misrepresented the thread count in its two-ply bedding products sold in Bed Bath stores and on its Web site by stating the number of threads in the warp and filling directions in one square inch of fabric, rather than the number of yarns.
Subject to final court approval, the parties have agreed to a settlement under which customers may be entitled to receive a refund on the purchase price of the bedding products or a $10 gift card from Bed Bath or a 20 percent discount certificate off any Bed Bath purchase up to $250. Bed Bath has also agreed that for a period of five years that its multi-ply bedding products will be labeled in accordance with standards for determining thread count.
Bed Bath and Synergy deny any wrongdoing, claiming that the signage, labeling and product samples provided customers with complete and accurate information.
Customer eligibility for the refund or other discounts depends on whether or not a proof of purchase is for the Aug. 1, 2000, to Nov. 9, 2007, time frame.
