ARCADIA, Wis.–Ashley Furniture Industries said yesterday that it has settled its pending patent infringement lawsuit brought against Lifestyle Enterprise involving the ornamental carvings of two of Ashley’s bedroom collections.
The lawsuit concerns Ashley’s U.S. Design Patent Nos. D518,311, D518,660 and D519,286 relating to the ornamental design of Ashley’s B547 South Shore and B553 North Shore bedroom set collections. Under the terms of the settlement agreement, Lifestyle agreed to discontinue selling the accused group B6144 that was at issue in the lawsuit, and Lifestyle has agreed to pay an undisclosed amount to Ashley, according to a release. Prior to the settlement, the United States District Court for the Western District of Wisconsin dismissed Lifestyle’s defense that Ashley’s patents were invalid.
Greg Noe, group president and chief operating officer of Lifestyle Enterprise, confirmed the terms of the settlement, but declined to comment further.
